Hey everyone, I was in a pretty bad wreck a few days ago. A semi-truck ran a red light and slammed into my driver side. I am mostly okay but my car is a total loss and my neck is starting to feel really stiff. The trucking company's insurance has called me like four times today already trying to get a recorded statement. My brother says I shouldn't say a word and need to call a lawyer immediately, but I've never had to do that before and I'm worried about the cost. Has anyone been through this? Do I really need an attorney this early or should I just hear what their offer is first?

Listen to your brother—don't pick up that phone!

Man, I am so sorry to hear about your accident. Getting hit by a semi is no joke, and honestly, it’s a miracle you’re up and walking. I went through something similar a few years back (though it was a delivery van, not a massive rig), and the pressure those insurance adjusters put on you is incredibly stressful.

To answer your main question: Do not give them a recorded statement yet. Here is the deal with trucking companies—they have massive insurance policies and teams of lawyers whose entire job is to minimize what they pay out. They are calling you four times a day because they want to catch you while you’re still in shock or before you realize the full extent of your injuries.

Why you should wait to talk to them

  • Injuries hide: You mentioned your neck is getting stiff. That’s a huge red flag. Adrenaline masks pain, and soft-tissue injuries like whiplash often take a few days or even weeks to fully "show up." If you tell them today "I'm mostly okay" on a recorded line, they will use that against you later if you find out you have a herniated disc.
  • The "recorded" trap: They are trained to ask leading questions. They might ask, "How are you doing today?" and if you say "I'm fine, thanks," they can argue in court that you admitted you weren't injured.
  • Trucking regulations are complex: Semi-truck accidents involve federal laws and logbooks that a regular person just wouldn't know how to look for.

Addressing the cost of a lawyer

I totally get the worry about money, especially with a totaled car, but here is the secret: Most personal injury lawyers work on a contingency fee. This means they don't charge you a single penny upfront. They only get paid if they win your case, taking a percentage of the settlement. Usually, the initial consultation is 100% free.

In my experience, even after the lawyer takes their cut, people usually end up with way more than if they had taken the insurance company's first "lowball" offer. Those initial offers are almost always just enough to cover your car, but they completely ignore your future medical bills or the pain you're dealing with.

What I would do right now

If I were in your shoes, I’d do two things immediately:

1. Go to a doctor or urgent care. Get your neck documented right now. "Stiff" can turn into "chronic pain" very quickly, and you need a paper trail.

2. Call a local personal injury attorney. Just have a 15-minute chat with one. They can take over the phone calls so the insurance company stops hounding you. It’s such a huge weight off your shoulders to just say, "Talk to my lawyer," and hang up the phone.

Stay safe and definitely don't let them rush you into signing anything!
