So, I got rear-ended about two weeks ago. The guy admitted it right there, and the police report says the same. I've tried calling his insurance (it's a smaller company I've never heard of) like five times now and I just get the runaround or put on hold forever. My car is basically undrivable and I'm starting to get worried about medical bills for my neck. Should I just call a car accident lawyer at this point or try to go through my own insurance first? I don't want my rates to go up for something that wasn't my fault.

Dealing with a non-responsive insurance company after an accident

Man, I am so sorry you’re dealing with this. There is honestly nothing more frustrating than being the victim in a crash and then getting treated like you don’t exist by the other person's insurance. It’s a total headache, especially when you have a car sitting there undrivable and a neck that’s giving you trouble.

In my experience, here is how you should probably handle this to get things moving:

1. Call your own insurance company immediately. I know you're worried about your rates going up, but this is exactly what you pay them for. If you have collision coverage, your insurance will pay to get your car fixed (minus your deductible) and then they will go after the other guy's "ghosting" insurance company to get their money back. This process is called subrogation. Once they win, you usually get your deductible back, too. In many states, insurance companies actually aren't allowed to raise your premiums if you were 0% at fault, so definitely check your local laws on that.

2. Don't ignore the medical side. Since you mentioned your neck, this has moved beyond just a "fender bender." Neck injuries (like whiplash) can sometimes take weeks to fully show up, and medical bills pile up fast. If you have PIP (Personal Injury Protection) or MedPay on your own policy, that can help cover your doctor visits regardless of who was at fault.

3. It might be time to talk to a lawyer. Normally, for a tiny scratch, I’d say just handle it yourself. But since the other company is ignoring you and you're injured, a car accident lawyer can be a huge help. They are experts at "waking up" these smaller, unresponsive insurance companies. Most work on a contingency basis, meaning they don't get paid unless you win, and they can handle the phone calls so you can focus on physical therapy.

A few quick tips for right now:

  • Get the police report: Make sure you have the hard copy or the report number ready. Your insurance will want this to prove the other guy admitted fault.
  • Document everything: Keep a log of every time you called that other company, who you spoke to (if anyone), and how long you were on hold.
  • Stop chasing them: If they've ghosted you for two weeks, they likely aren't going to suddenly start being helpful. Let your insurance or a professional take the wheel.

Hang in there. Dealing with those "off-brand" insurance companies is a notorious slog, but don't let them wear you down into paying for this out of your own pocket. Get your own company involved today so you can at least get your car back on the road!
